Budgam Special NIA Court Orders Attachment of Land Belonging to US-Based Kashmiri Lobbyist

Budgam: The Special NIA Court in Budgam, Srinagar, has passed a significant order directing the attachment of land belonging to US-based Kashmiri lobbyist Ghulam Nabi Shah, also known as “Dr Fai.” The order was issued in connection with an ongoing terrorism-related case in which Shah’s role has been found to be suspicious.

On Tuesday, the Special NIA Court of Budgam district in the Kashmir division ordered the attachment of more than 1.5 kanals of land owned by Shah. The order was passed by Judge Yahya Firdous after Assistant Public Prosecutor Mohammad Iqbal Rather moved an application under Section 83 of the Criminal Procedure Code (now BNSS Section 85), seeking attachment of Shah’s property.

The prosecution argued that Shah had already been declared a proclaimed offender by the same court in 2020 in a case registered under various sections of the Unlawful Activities (Prevention) Act (UAPA).

In its seven-page order, the court directed the District Collector, Budgam, to attach and take immediate possession of the immovable property, including one kanal and two marlas of land under Khewat No. 60, Survey No. 466 in village Wadwan, and 11 marlas of land under Khewat No. 136, Survey No. 343 in village Chattabugh, belonging to Shah.

The court further instructed that, prior to attachment, the District Collector must ensure proper identification and demarcation of the property with the assistance of revenue officials.

Additionally, the court directed the Senior Superintendent of Police, Budgam, to provide necessary assistance to the District Collector during the attachment process, if required.
